New York State Tax Filing

You must file your US Federal Tax Return before you can file the New York State returns. Use the tax software which the ISSO has purchased (SPRINTAX) to help you file the US federal tax forms which is NOW available through our website. It is free for you to fill out the US federal tax forms using SPRINTAX. SPRINTAX will also prepare your New York state tax forms for you for a fee of $26. If you do not want to pay the $26 fee to fill out your New York State tax forms, you can follow the directions here to fill them out yourself.

Deadline: April 18, 2017

FIRST — Am I a resident or non-resident for New York State tax purposes?

All undergraduate students who are considered NON-residents for US federal tax purposes (the software determines this), ARE considered non-residents for New York State tax purposes.

Graduate students and J1 researchers or professors who are considered NON-residents for US federal tax purposes (the software determines this), answer these questions to determine your New York State Tax status:

  • Did you rent an apartment (not a dorm room) in New York State for 11 months or more of the year 2016?
  • Did you spend more than 183 total days in New York state in 2016?

Graduate students and J1 researchers or professors who answer "YES" to BOTH of these questions are considered residents for New York State tax purposes. If you answered "NO" to either one of these questions, you are a nonresident for tax purposes in New York State.

SECOND — Do I need to file NYS forms at all?

You are required to file a New York State tax return if:

  1. New York State taxes were withheld from your income in 2016 and you want a refund, OR
  2. You are a NY State NON-resident for tax purposes and you received more than $7,950 in 2016 from a US source, AND some of that is from a New York source, OR
  3. You are a New York State RESIDENT for tax purposes and you received more than $4,000 in 2016 from a US source, AND some of that is from a New York source.

If the above do not apply to you, you are not required to file a New York State tax return!
